Terms & Conditions

1. Booking Contract

Yamayama Travel operates as an independent contractor for all suppliers that provide transportation, accommodations, activities, and other services related to your trip. We do not own, operate, or control any of the service providers that offer accommodations, meals, transportation, sightseeing activities, or other goods and services connected with your trip. These service providers are solely responsible for their performance. Yamayama Travel, along with its owners, shareholders, officers, employees, directors, agents, consultants, representatives, volunteers, trip leaders, guides, suppliers, and their subcontractors, successors, and assigns, is not liable for any negligence, intentional acts, financial insolvency, or defaults of any supplier or third party. We do not possess any special knowledge regarding the financial status of our suppliers. The goods and services provided by suppliers are subject to their own terms and conditions and liability waivers, as well as applicable local laws and regulations.

 

Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage, which will apply to you as far as the relevant carrier or supplier is concerned. Some of these conditions may limit or exclude liability on the part of the transport provider or other supplier, and they are often governed by various international conventions.

2. Responsibility

These service providers are solely responsible for their performance. Yamayama Travel, along with its owners, shareholders, officers, employees, directors, agents, consultants, representatives, volunteers, trip leaders, guides, suppliers, and their subcontractors, successors, and assigns, is not liable for any negligence, intentional acts, financial insolvency, or defaults of any supplier or third party. We do not possess any special knowledge regarding the financial status of our suppliers. 3. Deposit and Payment Schedule

To secure your booking, a non-refundable deposit of 30% of the total quoted amount for the trip is required upon confirmation. The remaining balance of 70% must be paid no later than 60 days before your scheduled departure. If the final or full payment is not received 60 days prior to the departure date, Yamayama Travel reserves the right to cancel your booking without refund or compensation.

4. Cancellation by Traveller

If you need to cancel your trip, written notification must be received by Yamayama Travel from the person who made the booking. The date we receive your cancellation notice will determine the applicable cancellation fees.

  • 61 days or more before departure: The deposit is non-refundable but will be issued as a travel credit, which can be transferred to another trip.

  • 60-31 days before departure: 50% of the trip cost is non-refundable. Any additional amount paid will be refunded.

  • 30 days or less before departure: No refund is possible.
     

No refund is due if a traveller fails to join a trip, joins it after departure, or leaves it prior to its completion for any reason.

5. Cancellation by Us

While it is rare for us to cancel your Yamayama Travel trip after booking, we reserve the right to do so if necessary. In such an event, we will notify you as soon as possible.

If a trip is cancelled due to reasons within Yamayama Travel's control and not due to force majeure, we offer the following options:

  • A travel credit equal to the trip cost you have paid.

  • A refund equal to the trip cost you have paid.
     

We regret that we cannot accept liability or provide compensation if the fulfilment of our contractual obligations is hindered or impacted by force majeure. If Yamayama Travel is unable to comply with these terms and conditions due to force majeure, we will not be liable to compensate you if we have to cancel or modify your Yamayama Travel trip in any way due to circumstances beyond our control, either before or after departure. In these booking conditions, "force majeure" includes, but is not limited to, Acts of God, war, threat of war, riot, civil or political unrest, strikes, boycotts, industrial actions or disputes, actual or threatened terrorist activity and its consequences, natural or nuclear disasters, fire, adverse weather conditions, epidemics and pandemics, compliance with any law, regulation, ordinance, by-law, or permit, or any lawful direction, order, or request from an authority or court, closure of ports or airports, air traffic control delays, unavoidable technical and/or financial problems with transportation, or any other cause reasonably beyond the control of Yamayama Travel.

6. Passports, Visas, And Other Travel Documentation

It is essential that you carry a valid passport and have obtained all the necessary visas, permits, certificates, proof of vaccinations, and other travel documents required for the countries you will visit during your trip. Your passport must be valid for at least six months beyond the duration of your trip. It is your responsibility to ensure that you meet all entry requirements and possess the correct visas, permits, and certificates for your journey, with all information on these documents being accurate. Yamayama Travel is not responsible if you are denied entry to a country due to incorrect or missing passport, visa, or other travel documentation.

7. Fitness For Trip, Medical Conditions & Special Requirements

By booking a trip with Yamayama Travel, you affirm that you do not have any illness, physical, or other conditions that would pose a risk to yourself or other travellers, or affect others' enjoyment of the trip. Yamayama Travel cannot guarantee the condition or availability of medical facilities in the countries where our trips are conducted, which may include visits to remote or less developed areas. Therefore, it is the traveller’s responsibility to consult with their physician regarding any medical conditions before booking a trip with us.

Participants are advised to check with consulates for the latest health requirements. You must bring your own medications, insect repellent, or other recommended prescribed drugs, including but not limited to allergy medication (e.g., EpiPen).

If you have special needs, please inform us at the time of booking. Unless and until specifically confirmed, all special requests are subject to availability. We will make reasonable efforts to communicate any dietary restrictions to your trip guides and certain service providers. However, due to the nature of our trips and the fact that we do not operate or manage our suppliers, we cannot guarantee that any dietary needs or restrictions can be accommodated. Yamayama Travel is not liable for any failure to accommodate or fulfill any special requests or needs. It is your sole responsibility to ask necessary questions and make informed decisions about your dietary needs and restrictions while travelling.

8. Traveller's Responsibility

During the entire trip, the decisions made by Yamayama Travel's appointed guide or any other designated representative will be final on all matters concerning the safety and well-being of clients, as well as the operational requirements of the trip. By travelling with Yamayama Travel, you agree to abide by the authority of the appointed guide or designated representative. You must comply with all applicable laws and regulations of the areas visited during the trip and show respect for local customs and culture.

Miscellaneous charges for additional services, products or activities not included in the trip invoice will be borne by you.

9. Assumption of Risk

You acknowledge that the nature of trips organised by Yamayama Travel involves an element of personal risk and may expose you to potential hazards associated with adventure travel.

By participating in trips organised by Yamayama Travel, you agree to undertake them at your own risk and of your own volition. You hereby release Yamayama Travel from all claims and causes of action arising from any damages, injuries, or death resulting from these risks inherent in travel and participation in adventurous activities organised by Yamayama Travel.

10. Travel Insurance

We strongly recommend that you obtain personal travel insurance with sufficient coverage for medical expenses, evacuation, and repatriation, encompassing all applicable dates of your travel with Yamayama Travel. You accept full responsibility for securing insurance up to the relevant limits that you may require. It is your duty to ensure that the travel insurance you purchase adequately covers, among other things and where applicable, personal accident/injury, medical expenses, air ambulance, adventure travel, mountaineering, loss of personal effects, repatriation costs, and all other expenses that might arise in connection with the trip.

Furthermore, it is solely your responsibility to secure comprehensive travel insurance that will adequately reimburse you in the unfortunate event that you are unable to make the trip due to unforeseen circumstances. These circumstances may include, but are not limited to, flight delays, flight cancellations, medical reasons, or other force majeure events.

You are responsible for ensuring that your insurer is fully aware of the type of travel and the nature of the activities you will be undertaking during your trip with Yamayama Travel.

11. Severability

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision.

12. Images Release and Social Media

You grant Yamayama Travel permission to use, re-use, link to, repost, and reproduce any images, photos, videos, or written content (such as blog posts or articles) that you provide to us, that are captured by our guides, trip leaders, or fellow travellers featuring you individually or in a group, or that you post online using our designated hashtags (e.g., #YamayamaTravel). This permission extends to any medium, including but not limited to print, electronic media, or the Internet, and is granted free of charge and without your right to inspection. The purpose of this usage is for promoting and publicising our travel products and services worldwide. We will make efforts to provide appropriate attribution where possible.

If you wish to opt out of this Images Release, you must notify us in writing before the commencement of your trip, explicitly stating your intention to opt out. If you do not contact us with such a request, it will be understood that you have agreed to these terms regarding image usage and social media content.

13. Applicable Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes in relation to these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of the Republic of Singapore.

14. Data Protection

To facilitate your booking and ensure smooth holiday arrangements, Yamayama Travel may need to share the information you provide with relevant suppliers, including but not limited to airlines, transfer companies, and hotels. This information may also be shared with credit checking companies and public authorities such as customs and immigration if required by law.

We are committed to protecting your privacy and will only use your personal information for the purpose of arranging and managing your travel experiences. Your data will be handled in accordance with applicable data protection laws and regulations.
